This Privacy Policy explains what information LM Ventures LLC, a Minnesota limited liability company ("we," "us"), collects through alreadyfiled.com and the Already Filed service, and how we use it. Already Filed is a name used by LM Ventures LLC.

Already Filed is a private company (LM Ventures LLC). We are not the State of Minnesota, the Department of Commerce, or the state's benchmarking help desk, and we're not endorsed by them.

We never sell your data

We do not sell, rent, or trade your information, and we don't use it for advertising.

What we collect

• What you put in our forms. Building address and city, your name, email, and role; and, if you add them, square footage, building type, who holds the meters, number of tenants, utility companies, phone number and notes.
• Utility and building data. Monthly energy and water use and account details that you, your tenants or your utilities provide, or that we request from utilities on your behalf with your authorization.
• ENERGY STAR Portfolio Manager access. If you share your property with us in Portfolio Manager, or ask us to set one up, we can see and edit the property data there.
• Payment information, handled by Stripe. Stripe collects your card details directly on its checkout page; we never see or store your full card number. We receive limited details from Stripe, such as your name, billing email, billing ZIP or country, the last four digits and brand of your card, and your payment status.
• Messages you send us, such as questions and approvals.
• Basic technical data, such as IP address, browser type and pages requested, which our hosting provider logs to keep the site running and secure.

How we use it

To check whether your building is covered, quote a price, prepare and file your building's benchmarking reports with the State of Minnesota (and Minneapolis or Edina if your building needs it), remind you about the next year's report, answer your questions, prevent fraud and abuse, enforce our Terms, and meet legal obligations. We contact you by email only, unless you ask us to call.

Who we share it with

We share information only as needed to do the work:

• the reporting systems we file to, including ENERGY STAR Portfolio Manager, the State of Minnesota's benchmarking system, and Minneapolis or Edina if your building must also report there;
• utilities, to request your building's usage data with your authorization;
• Stripe, our payment processor, for card payments and refunds;
• Resend, our email delivery provider, which processes your email address and delivery data (such as whether a message was delivered or bounced) to send our emails;
• Cloudflare, which hosts our website and stores our intake records.

We may also disclose information if the law requires it, to protect our rights or others' safety, or as part of a sale or reorganization of our business. Benchmarking data that is filed with a government may become public under that government's rules.

Your choices

See, correct or delete your information. Email [email protected]. We'll take reasonable steps to confirm the request comes from you, for example by replying to the email address you gave us. We may keep information we need for legal reasons, such as billing and tax records and copies of filed reports.

State privacy rights. Depending on where you live (including Minnesota), you may have additional rights under state law, for example to know, access, correct, delete, obtain a copy of, or opt out of certain processing of your personal data. We will honor applicable rights as the law requires. To appeal a decision on a privacy request, email us with "Appeal" in the subject line.

Portfolio Manager access. You can remove our access to your property in Portfolio Manager at any time.

Do Not Track. We don't track visitors across other websites, so we don't respond differently to browser "Do Not Track" signals.

How long we keep it

We keep your information while we're working for you and for a reasonable period afterward for billing, tax, legal and dispute purposes and to help with future years' reports, then delete it. If you only asked for a quote and didn't go ahead, you can ask us to delete your request at any time.

Cookies and analytics

Our site does not use advertising cookies, third-party tracking pixels or analytics that profile individual visitors. Stripe sets its own cookies on its checkout pages to process payments and prevent fraud. If we change this, we will update this policy.

How we protect information

We use reasonable administrative, technical and physical safeguards. For example, the site is served only over encrypted HTTPS connections, card payments are handled by Stripe, and we limit who can see your records. No website or storage system is completely secure, so we can't guarantee absolute security.

Children

Our service is for building owners, managers and businesses. We don't knowingly collect personal information from children under 13.

Changes to this policy

We may update this policy from time to time. When we do, we'll post the new version here and change the date at the top. If we make a significant change to how we share personal information, we'll post a clear notice on the site before it takes effect.
